WhatsApp risks and user responsibility

Please read this notice carefully before using WhatsApp features on the platform.

Important notice

The platform provides only a technical software interface. WhatsApp messages are sent via the user’s own device and/or the user’s own WhatsApp account. The user bears all risks related to the use of WhatsApp.

1. Nature of the service

The provider offers software that can technically interact with the user’s own device, SIM card, and WhatsApp account. The provider is not WhatsApp, not a telecommunications carrier, and not a messaging network operator.

The provider does not become a party to the communication between the user and message recipients.

2. Use of the user’s own WhatsApp account

All WhatsApp communication is carried out exclusively using the user’s own WhatsApp account, phone number, device, and technical environment.

The provider has no control over the account status, trust level, internal platform restrictions, or enforcement decisions made by WhatsApp or related companies.

3. Risk of limitation, suspension, or blocking

The use of WhatsApp may involve risks, including temporary limitations, reduced delivery, account review, suspension, or permanent blocking of the WhatsApp account or related phone number.

Such measures may be triggered by WhatsApp or third parties for reasons outside the provider’s control, including message volume, content, user reports, technical patterns, automation signals, account reputation, or internal policy enforcement.

The provider is not responsible for any limitation, warning, verification request, suspension, or blocking imposed by WhatsApp.

4. No guarantee of delivery or availability

The provider does not guarantee uninterrupted availability of WhatsApp-related functions, message delivery, message speed, account availability, or continued compatibility with WhatsApp.

Technical changes by WhatsApp, Android vendors, device manufacturers, network operators, or other third parties may affect or prevent proper operation at any time.

5. User responsibility

The user is solely responsible for:

  • the legality of message content
  • the legality of recipients and contact lists
  • obtaining all required consents and permissions
  • compliance with WhatsApp terms, policies, and applicable laws
  • the use of the user’s own devices, SIM cards, numbers, and accounts
  • all consequences resulting from message sending activities

6. Prohibited use

The user may not use the platform for:

  • spam or unsolicited communications
  • fraudulent, deceptive, abusive, or unlawful content
  • harassment, phishing, or misleading campaigns
  • violations of privacy, consumer, competition, telecommunications, or data protection law
  • any activity that violates the rules of WhatsApp or third-party providers

7. Limitation of liability

To the extent permitted by law, the provider shall not be liable for losses or damages arising from the use of WhatsApp-related functions, including blocked accounts, restricted numbers, undelivered messages, delays, data loss, business interruption, reputational damage, or loss of profit.

Mandatory statutory liability, in particular for intent, gross negligence, or injury to life, body, or health, remains unaffected.

8. Indemnification

The user shall indemnify and hold harmless the provider from and against third-party claims, costs, fines, damages, and expenses arising out of unlawful or contract-breaching use of the platform by the user, insofar as legally permissible.

9. Acknowledgement by the user

By using WhatsApp-related functions of the platform, the user confirms that they understand and accept these risks.

The user acknowledges in particular that the provider does not assume responsibility for the operational status or continued availability of the user’s WhatsApp account.
